Terms of Service

By creating an account or using XAHKIDS, you agree to these Terms of Service. If you do not agree, do not use the service. Because XAHKIDS is used by children under parental supervision, the parent or guardian creating the account accepts these terms on behalf of the household.

XAHKIDS is an educational reading application. It is a learning tool designed to support reading comprehension for neurodivergent learners. XAHKIDS is not a clinical, diagnostic, or medical device. It does not diagnose, treat, or remediate any condition, and it is not a substitute for professional educational or clinical support.

Accounts must be created by a parent or guardian who is 18 years or older. The account holder is responsible for the child's use of XAHKIDS and for any activity under the account. You agree to keep login credentials secure and to notify us of any unauthorized use.

XAHKIDS is currently free to use. We may introduce paid features in the future. If we do, we will give advance notice to existing users before any paid features take effect. Any paid features will be clearly disclosed, and you will not be charged unless you affirmatively opt in.

You may delete your account at any time from within the app. Deletion removes the child's profile and associated reading data, subject to our Privacy Policy. Because the service is currently free, there is no billing to cancel.

You agree not to:

• Use XAHKIDS for any unlawful or harmful purpose.
• Attempt to access another user's account or data.
• Reverse engineer, scrape, or disrupt the service.
• Use the service to harm a child or any person.

We may suspend or terminate access if we believe these terms have been violated.

XAHKIDS, its stories, characters, artwork, and software are owned by XAHKIDS and its licensors. You receive a limited, non-exclusive, non-transferable license to use the service for personal, household, educational use. You may not copy, redistribute, or commercially exploit the content.

A child's reading responses and progress are user content associated with the parent's account. The parent retains ownership of this content. We use it only to deliver and personalize the service and to display progress, as described in the Privacy Policy. We do not sell user content.

XAHKIDS is provided "AS IS" and "AS AVAILABLE." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability and fitness for a particular purpose. We make no warranty regarding efficacy, learning outcomes, or any medical, behavioral, or developmental benefit. Use of XAHKIDS does not guarantee any specific result.

To the fullest extent permitted by law, XAHKIDS and its affiliates are not liable for any indirect, incidental, special, or consequential damages arising from use of the service. Total liability for any claim is capped at the lesser of (a) the fees you paid us in the 12 months preceding the claim, or (b) $100. Because the service is currently free, monetary liability is nominal.

Any claim arising out of or related to XAHKIDS must be brought within one (1) year after the event giving rise to the claim, or it is forever barred.

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any dispute arising out of or related to these Terms or the service that cannot be resolved informally will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its consumer rules. The arbitrator's award is final. Both parties waive the right to participate in a class action and to a jury trial. Small claims court matters may proceed outside arbitration where permitted by law.

We may update these Terms from time to time. We will update the "Last updated" date and, for material changes, notify parents through the app or by email. Continued use after changes take effect constitutes acceptance of the updated Terms.

You agree to indemnify and hold harmless XAHKIDS and its affiliates from any claim, damage, or expense arising from your misuse of the service or your violation of these Terms.

We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including acts of God, internet or utility outages, or third-party service disruptions.

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and XAHKIDS regarding the service.
